1. Eligibility

By accessing or using marcusvance.com, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction), have the legal capacity to enter into binding agreements, and agree to be bound by these Terms.

If you are accessing the platform on behalf of a company or legal entity, you represent that you have the authority to bind that entity. These Terms then apply to both you and the entity.

2. Account Registration

To access paid content, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security of your password and accept responsibility for all account activity
• Notify us immediately at contact if you suspect unauthorized access
• Not share, transfer, or sell your account credentials to any third party

3. Subscription Plans & Payments

3.1 Monthly Subscription

Your monthly subscription automatically renews on your billing anniversary date unless cancelled. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then. No partial-month refunds are issued.

3.2 Lifetime Access

The Lifetime plan grants you permanent access to the content library, including all future courses added after your purchase date, at no additional charge. “Lifetime” refers to the operational lifetime of the platform. In the unlikely event that the platform ceases operation, we commit to providing at least 90 days’ advance notice.

3.3 Crypto Payments

We accept major cryptocurrencies (BTC, ETH, USDT) as payment. Crypto payments are processed at the exchange rate at time of transaction and are non-refundable due to the irreversible nature of blockchain transactions. Crypto purchases of the Lifetime plan are final.

3.4 Taxes

Prices displayed are exclusive of applicable taxes. Depending on your location, VAT or local sales tax may be added at checkout. You are responsible for any taxes applicable to your purchase under local law.

3.5 Price Changes

We reserve the right to change subscription prices. Active monthly subscribers will receive at least 30 days’ written notice before any price change takes effect. Lifetime members are not subject to price changes after their one-time purchase.

4. Content Access & License

Upon active subscription or lifetime purchase, we grant you a personal, non-exclusive, non-transferable, revocable (for monthly) or irrevocable (for lifetime, subject to Section 8) license to access and view course content for personal, non-commercial educational purposes only.

This license explicitly prohibits:

• Downloading, copying, or distributing course materials without written authorization
• Using content for commercial purposes, resale, or to create competing products
• Recording screen captures of video content
• Sharing login credentials or access links with non-members
• Using course methodologies in products or services marketed as derivatives of Marcus Vance content

5. Acceptable Use

You agree not to use the platform to:

• Violate any applicable law or regulation
• Transmit harassing, fraudulent, or harmful content
• Attempt to gain unauthorized access to platform systems or other accounts
• Use automated tools to scrape, crawl, or extract content
• Interfere with platform integrity, performance, or availability
• Impersonate Marcus Vance, Lucky North Star LLC, or any platform representative

6. Intellectual Property

All content on marcusvance.com — including but not limited to course videos, PDFs, workbooks, frameworks, methodologies, graphics, brand assets, and written materials — is the exclusive intellectual property of Lucky North Star LLC or its licensors, protected by applicable copyright, trademark, and intellectual property laws.

Your access to the platform does not transfer any ownership of intellectual property to you. “Marcus Vance” and the MV logo are trademarks of Lucky North Star LLC. Unauthorized use of our trademarks is prohibited.

7. Disclaimer & Limitation of Liability

The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Lucky North Star LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform.

Our aggregate liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the total amount paid by you in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account and access at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to the platform, other users, third parties, or our business interests.

Upon termination for cause: access is revoked immediately and no refund is issued, including for Lifetime members. Upon voluntary cancellation of a monthly subscription: access continues until the billing period ends.

Termination reasons include but are not limited to: account sharing, content piracy, chargebacks filed in bad faith, misrepresentation, or violation of any section of these Terms.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Mandatory arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the platform shall be resolved by binding arbitration administered by JAMS under its Commercial Arbitration Rules. Arbitration shall be conducted in English. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

For disputes under $10,000 USD, either party may elect to resolve the dispute through small claims court rather than arbitration.

Monthly Subscription — No Prorated Refunds

Monthly subscriptions may be cancelled at any time. Upon cancellation, your access continues until the end of the current billing period. No partial-month refunds are issued for unused days.

To cancel: access your account dashboard → Billing → Cancel Subscription. Your access will end on the next billing date. You will not be charged again.

Lifetime Access — No Refund Policy

The Lifetime Access plan is sold on a no-refund basis. Here is why: the moment you purchase Lifetime Access, you gain immediate, permanent access to the full course library — including content valued at significantly more than the purchase price. The value delivery is instantaneous and irrevocable.

Exceptions (processed within 14 days): duplicate charges or technical billing errors documented with transaction records. Contact us at our contact page with supporting documentation.

Crypto Payments — Non-Refundable

All cryptocurrency payments are final and non-refundable due to the irreversible nature of blockchain transactions. Please verify your purchase details carefully before completing a crypto payment.

Chargebacks

Filing a chargeback while retaining platform access constitutes fraud. We actively dispute chargebacks with full transaction documentation. Accounts subject to chargebacks are immediately suspended and permanently banned from future purchases. If you have a legitimate billing concern, contact us before filing a chargeback — we will resolve it promptly.

Information We Collect

We do not collect sensitive personal data (health, biometric, financial account details). Full payment card details are processed exclusively by Stripe and are never stored on our servers.

How We Use Your Information

• Service delivery: Provide, maintain, and improve your account and course access
• Billing: Process payments, send receipts, manage subscriptions
• Communications: Send transactional emails (purchase confirmation, password reset), and, with consent, marketing communications
• Analytics: Understand how users interact with the platform to improve content and UX
• Affiliate tracking: Attribute sales to affiliate partners using cookie-based tracking
• Legal compliance: Meet applicable legal obligations, respond to lawful requests
• Security: Detect and prevent fraud, unauthorized access, and abuse

We do not sell your personal data to third parties. We do not use your data to train AI/ML models without explicit consent.

Your data may be transferred to and processed in countries other than your country of residence, including the United States. We ensure appropriate safeguards are in place (including Standard Contractual Clauses where required by EU law).

Overview

The Marcus Vance Affiliate Program allows approved members to earn a 40% commission on net sales (after taxes and payment processor fees) generated through their unique referral link. This is one of the most competitive affiliate rates in the business education market.

Eligibility & Application

To apply, you must be an active Marcus Vance member (Monthly or Lifetime). Applications are reviewed within 5 business days. We reserve the right to approve or reject applications at our discretion, and to terminate affiliate status at any time for cause.

Commission Structure

Commissions are calculated on the net amount after payment processing fees. Commissions are credited to your affiliate account 30 days after the sale (to allow for any billing disputes). Monthly subscription commissions are recurring — you earn each month the subscriber remains active.

Prohibited Practices

Affiliates are prohibited from:

• Bidding on “Marcus Vance” brand keywords in paid search advertising
• Misrepresenting the platform, its content, or projected earnings
• Using spam, fake reviews, cookie stuffing, or artificial click generation
• Referring your own purchases (self-referral)
• Creating misleading comparison sites or fake testimonials
• Using any deceptive or unethical marketing practice

Violation results in immediate termination, forfeiture of pending commissions, and may result in legal action for fraud.

Payments & Tax

Affiliate payments are processed monthly on the 15th of each month for commissions earned in the previous month. Minimum payout threshold: $50. Affiliates earning over $600 USD in a calendar year (US residents) will receive a 1099 form and must report earnings for tax purposes. International affiliates are responsible for compliance with local tax law.
